Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Miguelito website, waitlist, and AI business operating system (collectively, the “Service”). Miguelito is created in Cyprus and built for founders worldwide. By accessing the Service or joining the waitlist, you agree to these Terms.
1. Who we are
The Service is provided by Miguelito, operating from the Republic of Cyprus. Contact: hello@miguelito.ai.
2. The Service
Miguelito is an autonomous AI business manager that can help operate marketing, sales follow-up, campaigns, content, inboxes, customer support, and related business workflows based on your instructions and configured permissions.
Miguelito is not a law firm, accounting firm, financial adviser, or licensed agency. You are solely responsible for your business decisions and compliance with laws applicable to your industry and jurisdiction.
3. Eligibility
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your business. By using the Service, you represent that you meet these requirements.
4. Waitlist and early access
Joining the waitlist does not guarantee access, pricing, or launch timing. We may offer early access, founding-member pricing, or beta features at our discretion. Waitlist communications may include email, SMS, or AI-assisted calls where you have consented.
5. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorised access.
6. Your content and data
You retain ownership of your brand assets, customer lists, content, domains, and business data (“Your Content”). You grant Miguelito a limited licence to use, process, store, and display Your Content solely to provide and improve the Service.
You represent that you have the right to provide Your Content and that its use through Miguelito does not violate third-party rights or applicable law.
7. Acceptable use
You agree not to use Miguelito to:
- Break any applicable law or regulation
- Send spam, deceptive messages, or unlawful robocalls
- Infringe intellectual property or privacy rights
- Harass, defraud, or harm others
- Attempt to reverse engineer, scrape, or disrupt the Service
- Use the Service for high-risk activities without appropriate human oversight
We may suspend or terminate access for violations.
8. AI outputs and approvals
Miguelito may generate drafts, campaigns, messages, and automated actions. You are responsible for reviewing outputs before publication where the Service requests approval. You acknowledge that AI can make errors and that you bear final responsibility for customer-facing communications.
9. Fees and billing
Pricing, billing cycles, and plan features will be presented at signup or purchase. Unless otherwise stated, fees are quoted in euros (€). Subscriptions renew automatically until cancelled in accordance with the plan terms presented at checkout.
We may change pricing for new customers; existing subscribers will be notified in advance where required by law.
10. Cancellation and export
You may cancel your subscription as described at signup. Upon cancellation, access may continue until the end of the billing period. You may export Your Content where export features are available. We do not claim ownership of your audience, domain, or brand.
11. Third-party services
The Service may connect to third-party platforms. Your use of those platforms remains governed by their terms. We are not responsible for third-party outages, policy changes, or data handling outside our control.
12. Intellectual property
Miguelito, its software, branding, website, and documentation are owned by us or our licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as permitted.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis. We disclaim all warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. See our Disclaimer for additional information.
14. Limitation of liability
To the maximum extent permitted by applicable law in Cyprus and the EU, Miguelito shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €100 if you have not paid fees, whichever is greater.
Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnity
You agree to indemnify and hold Miguelito harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law principles. Courts in Cyprus shall have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where applicable.
EU consumers may also use the European Online Dispute Resolution platform.
17. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may be notified by email or in-app notice where appropriate.
